Texas power providers Electric Reliability Council of Texas (ERCOT) and Entergy Corporation have been hit with a $100 million lawsuit accusing them of gross negligence in the death of a child whose family suspects he suffered hypothermia when they lost electricity and heat in their mobile home during a historic cold snap.

The mother of 11-year-old Cristian Pineda filed the wrongful death lawsuit in Jefferson County District Court, alleging the utility giants "put profits over the welfare of people" by ignoring previous recommendations to winterize its power grid, which sustained an epic failure last week and left more than 4 million customers without heat and electricity as temperatures in some parts of the state plunged to single digits.

"Despite having knowledge of the dire weather forecast for at least a week in advance, and the knowledge that the system was not prepared for more than a decade, ERCOT and Entergy failed to take any preemptory action that could have averted the crisis and were wholly unprepared to deal with the crisis at hand," the lawsuit states.

Cristian died on Tuesday in his family's mobile home in the Houston suburb of Conroe while sharing a bed with his 3-year-old brother under a pile of blankets in an attempt to stay warm, according to the lawsuit.

“This is a young man who died for no reason other than corporate decisions," the Pineda family attorney Tony Buzbee told ABC News on Sunday. "There are a lot of decisions that were made a long time ago that led to the death of this young man. That is unacceptable."

The sixth grader, who migrated to the United States two years ago with his family, was a healthy boy who on the day before his death was playing in the snow for the first time in his life, his mother, Maria Pineda, told the Houston Chronicle.

I’m in Houston, I didn’t freeze to death, but I spent one night sleeping in my car with the heater on and another under 5 blankets with my dog. None of the houses have shot for insulation and it was fucking cold. I spent 3 nights without heat, realistically I probably could have survived another week, but this was totally the fuck up of the century by ERCOT. Even the middle class and rich white people lost power, they’re fucked.

How the fuck do you die? I have a shitty 1930s house with no insulation -- the drywall hackjob is literally nailed to shiplap sheathing in some spots. I live in the mountains; it was -30c last week. My bedroom is in the freezing fucking cold attic conversion, also with no insulation or heat. I love it. Nothing better than piling on every blanket in the house and getting cozy while things frost over. My cat cuddles right up against my leg for heat. Yes, very cozy.

Somehow none of us have frozen to death yet ???

i watched the radar all week before it rolled over my dirt patch of a state. even though we have the infrastructure to handle these temperatures, i still supplied up and had some extra gas cans in the garage ready for if we had to sleep in the car. no government department or fat cat electrical company could convince me to not stock up, that’s fucking stupid.

This was Texas, you can blame frozen turbines all you want, but this is because natural gas powered electric plants didn’t winterize their grid. This is because the grid is maintained by a nonprofit company, not a government entity and profit motive resulted in turbines, solar panels and gas plants all not winterizing their grid. Also, this is republican politics, this is Texas, there aren’t any lefties to blame in the government.

not from the us but im from a country where u might get -30C(-40C but that hasn happen in 10 or more yrs). u just have to drink ur beer faster than normal because it will freeze. i dont recall any deaths from younger people but some elderly with dementia have been found frozen to death and they mostly just get lost in the woods
